Statutory responsibilities under the Archives Act
In New Brunswick we have a provincial archivist who is responsible for the care, custody and control of public records. They are responsible to, among other things, prepare records schedules governing the retention, destruction and transfer of public records as well as to provide storage for and encourage the use of these public records.
The Archives Act contains the process for individuals wishing to access certain public records, which includes an application to the Public Records Committee. If the Committee denies the request to inspect the record, the individual can apply to the Ombud for a review. The Ombud will then inspect the record, in camera, and make a recommendation to either grant or deny the request.
